1. Introduction

Welcome to My Up-Keepers. By using our services, you agree to these Terms of Service. Please read them carefully. My Up-Keepers provides a coordination platform connecting homeowners with independent contractors and service providers for home maintenance and repair services.

2. Service Description

My Up-Keepers operates as a coordination and referral service. We connect clients with independent contractors, agents, and service providers ("Service Providers") who perform home maintenance, repair, and improvement work.

We do not directly employ the contractors or agents who perform work at your property. All Service Providers are independent businesses or individuals operating under their own licenses, insurance, and business practices.

3. Limitation of Liability

My Up-Keepers acts solely as a coordination service. We are not responsible for:

• The quality, safety, or legality of work performed by Service Providers
• Any property damage caused by Service Providers during the course of their work
• Any personal injury occurring during or as a result of services performed
• The accuracy of estimates, quotes, or timelines provided by Service Providers
• Any disputes between clients and Service Providers
• The licensing, insurance, or certification status of Service Providers
• Any consequential, incidental, or indirect damages arising from services

All Service Providers operate independently and are solely responsible for their own work, conduct, insurance coverage, licensing, and compliance with applicable laws and regulations.

4. Independent Contractor Relationship

All contractors, agents, and service providers connected through My Up-Keepers are independent contractors, not employees of My Up-Keepers. This means:

• Service Providers control how and when they perform their work
• Service Providers are responsible for their own taxes, insurance, and business expenses
• My Up-Keepers does not supervise, direct, or control the manner of work performed
• Any contract for services is between you (the client) and the Service Provider directly

5. Client Responsibilities

As a client using My Up-Keepers, you agree to:

• Provide accurate information about the work needed
• Ensure safe access to your property for Service Providers
• Pay for services as agreed with the Service Provider
• Communicate directly with Service Providers about job details and expectations
• Verify any licenses or insurance requirements important to you before work begins

6. Insurance & Licensing

My Up-Keepers does not guarantee that all Service Providers carry insurance or hold specific licenses. While we strive to work with qualified professionals, it is the client's responsibility to:

• Request proof of insurance from Service Providers if desired
• Verify licensing for work that requires it (electrical, plumbing, HVAC, etc.)
• Obtain permits if required for the work being performed

We recommend that clients verify insurance and licensing for any significant or high-risk work before it begins.

7. Indemnification

You agree to indemnify, defend, and hold harmless My Up-Keepers, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from your use of our services, your interactions with Service Providers, or any violation of these Terms.

8. Dispute Resolution

If you have a dispute regarding work performed:

• First, attempt to resolve the issue directly with the Service Provider
• Contact My Up-Keepers if you need assistance facilitating communication
• Any legal disputes are between you and the Service Provider directly

My Up-Keepers may, at its discretion, assist in mediating disputes but is not obligated to do so and is not a party to any service agreement between clients and Service Providers.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes arising from these Terms or your use of My Up-Keepers services shall be resolved in the courts of Union County, New Jersey.

10. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
